Washington Community Property - the Basics
Washington is a community property state. Generally, property acquired during marriage is presumed to be owned by the community. Both husband and wife have the right to control and manage community property. There are exceptions to the rules of property acquired during marriage including inheritance or gifts acquired during the marriage as well as the rent, profit or proceeds of separate property.
Washington state has produced a helpful handbook which is available on line through the King County Clerk website and simply titled Family Law Hand Book; the booklet is also given to parties by the court clerk when they file a dissolution of marriage.
The King County Clerk website: Family Court also allows access to forms and other helpful materials. If you have specific questions or need legal representation, please call 206-789-6655 or 425-882-7900.
Many people who have assets prior to marriage ask if they need a Prenuptial Agreement. The answer is not always simple. If you have substantial assets going into a marriage or wish to protect your assets or insurance for children of a prior marriage, you may want to consider such an agreement. Please call 206-789-6655 or 425-882-7900 to discuss your needs and concerns.
